Based on rules of impeachment trials, Chief Justice Roberts, who will preside over any impeachment trial of Trump, must exclude both @senatemajldr McConnell and @LindseyGrahamSC from playing any role in the proceedings. Or demolish the credibility of @Scotus forever…

.this is not even a close call. The only way any other decision can be made is to, once again, indulge the @GOP ‘s consistent abandonment of constitutional principles, permit perjurious oaths, accept lies, and once again treat the Constitution as an array of loopholes….

…Roberts must administer an oath to every Senator. The oath’s words are,”I solemnly swear (or affirm) that in all things appertaining to the trial of the impeachment of, now pending, I will do impartial justice according to the Constitution and laws: so help me God.”…

Now, @senatemajldr & @LindseyGrahamSC have both made blindingly clear that they plan to violate that oath, that they plan to say “so help me God,” and then say “I just lied to you, God.” They would be taking a false oath. Now….

..perjury is not a big deal for the GOP anymore, but lying in an oath to abide by the Constitution is so far over the line that it is nearly unrecoverable. A standard is met: Sworn oaths are just things Republicans say – they don’t really mean it, and have no intent to abide…

Now, take the words of the oath and lay it next to the words of @LindseyGrahamSC :

2. Lindsey: “I’m not trying to pretend to be a fair juror here…”

The only way around lying be for the Senate to change the rules and add…

…imagine: You’re a juror in a criminal trial. Before it starts, you stand up say, “Im not listening to evidence. I don’t care. I’m not an objective juror. I’m going to work with the defendant’s lawyer.” Does anyone believe that juror would be seated?….

…does anyone believe the proclamation by that juror that he/she intends to violate the oath is resolved by taking the oath? It’s obscene. And if Roberts winks & nods & let this go through without addressing it, the corruption of @GOP in every part of government is complete.

I won’t count on Chief Justice Roberts. Despite what he said, he knows that the courts are partisan. Money in politics, dark money, has stacked the deck against any semblance of fairness in America. Republicans played the long game, w/🤑, they’ve corrupted courts, institutions.

With right wing billionaires funding think tanks, funding universities, media; we the people don’t stand a chance, unless we have sustained, long term protests.

The average American, can’t do what is being done in countries that are fighting to have a democracy. But, we could work in shifts. Democracy was never easy. But, it’s really easy to lose it. Too many Americans are unaware of how fragile it is; many powerful people, ($)

are hoping we are too busy trying to survive, trying to pay the bills; on the pittance they pay us, while they get rich on our labor. And, they use the power that 💰 buys to rig the system. Demonizing taxes, for the common good; while the politicians they bought cut theirs,

so the average, every day worker, is paying taxes, while the corporations, & the rich use their tax free $ to …. “Keep us in our place”. 🤔 I think I’ve heard that phrase before; History rhymes. It doesn’t repeat. They are trying to prefect what didn’t work the 1st ⌛. 🕊

The real problem here, Roberts is merely overseeing the trial and holds no actual power. Mitch McConnell is the acting lead. We face a situation that the framers never envisioned. The only way to proceed with an actual prosecution, would be to put that “memo” to the test.

Actually bring criminal charges on the president. There is ZERO case law supporting the “memo”, it’s a preposterous “interpretation” that Mueller SHOULD have challenged. I’d say it’s time SOMEONE did. They can’t successfully argue something that does not exist. Charge him.

Mueller had no legal standing to challenge. Don’t blame him. The underlying problem is that all prosecutors ultimately work for POTUS. The memo is meaningless; it’s all about DOJ not wanting to be fired for prosecuting their boss.

He was not deputy AG. And again, he had zero legal standing with which to challenge an internal DOJ policy. Doing so would have given Barr proper cause to terminate him more directly than he did.

agreed. when does the defendant interview the jury or when does a juror say I want to meet with the defendant and help him with his case? The answer is, never. They would not be chosen as a juror in the 1st place, or jury tampering would be called out.
